Agreement
These Terms of Service ("Terms") are a contract between you and Blackhorse Publishing Inc("we", "us") for use of Palomino at blackhorsepalomino.com, related APIs, and client apps. By creating an account, clicking to accept, or using the service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
The service
Palomino provides a commercial encrypted VPN — device provisioning, cloud-hosted tunnel endpoints, and signed connection receipts. Features available to you depend on your plan. We may change, suspend, or discontinue features with reasonable notice when practicable. Palomino is not a media vault, watermarking product, or share-link service (those are offered separately by Greypony at greypony.company under a separate account and separate terms).
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) and able to form a binding contract. If you use Palomino on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for complying with local laws regarding VPN use.
Accounts
You are responsible for safeguarding your credentials, API keys, and device profiles, and for all activity under your account. Notify us promptly of any unauthorized use. Keep your contact email accurate so we can reach you about security, billing, and service notices. Palomino and Greypony accounts are separate unless you explicitly link them in Settings after verifying ownership of both emails.
Acceptable use
You agree not to:
- Misuse the VPN, attempt to breach its security, or circumvent plan limits or device-profile rules
- Share device profiles or credentials in violation of your plan
- Use the service for unlawful activity, abuse of networks, or attacks on third parties
- Interfere with other users or reverse engineer the service except where law permits
We may suspend or terminate accounts that violate these Terms or create risk to the service or other users.
Subscriptions and billing
Paid plans are billed through Stripe on a recurring basis until cancelled. Subscriptions are managed at blackhorsepalomino.com. Fees are non-refundable except where required by law. Taxes may apply.
The Basic tier requires a one-time $1 activation charge (a verified payment method on file for account accountability). This is a single charge, not a subscription, and does not renew.
Core and Sovereign plans each include a 30-day trial (one trial per workspace). A valid payment method is required at signup. Unless you cancel before the trial ends, your subscription automatically renews at $50/month (Core) or $400/month (Sovereign). You can cancel anytime through the billing portal to avoid future charges.
We may change prices with notice before the next billing period. Continued use after a price change takes effect constitutes acceptance of the new price for subsequent periods. Contact contact@blackhorsepalomino.com for billing questions.
Intellectual property
The Palomino software, dashboard, device configuration tools, and attestation infrastructure remain our property (or our licensors'). Connection receipts are provided for your audit use under your plan. These Terms do not transfer ownership of our IP to you.
Third-party services
The service depends on processors such as Supabase, Stripe, Vercel, cloud infrastructure providers, and email delivery providers. Their use of data is described in our Privacy Policy.
Termination
You may stop using the service and cancel paid plans through the billing portal. We may suspend or terminate access for violation of these Terms, non-payment, legal requirement, or if we discontinue the service. Upon termination, your right to use the service ends; provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, anonymity against all adversaries, or that the VPN will be available in every network or jurisdiction.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted.
Indemnification
You will defend and indemnify us against claims, damages, and expenses (including reasonable attorneys' fees) arising from your content or traffic, your use of the service, or your violation of these Terms or applicable law.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date will change when we do. Material changes will be posted on this page; continued use after the effective date constitutes acceptance. If you do not agree, stop using the service and cancel any paid plan.
Governing law
These Terms are governed by the laws of the United States and the State in which Blackhorse Publishing Inc is organized, without regard to conflict-of-law rules. Courts in that State will have exclusive jurisdiction over disputes, except where applicable law requires otherwise (including mandatory consumer protections in your country).
